Deedpolls
A deed poll is a legal document used to evidence a person’s change in name. If you are a Jersey domiciled resident and you wish to change your given name or your surname, you will need to submit an application to the Court to arrange for your change in name to be legally recognised.
The application made will depend upon your personal circumstances, including whether you are married, in the process of divorce or if the application is being made on behalf of a minor child. Viberts can assist with the drafting of the necessary documents and submission of those documents to court.
There is a court application of £60 that is payable to court at the time of the application.
Registration of foreign powers of attorney and guardianship orders
If you are not a domiciled Jersey resident and you have either made a power or attorney or you have been appointed as guardian under a guardianship order (or equivalent) in a country outside of Jersey, it will be necessary for that power of attorney or court order to registered with the Jersey Court before it can legally be used in the island. Registration of wills of immovable estate
When a person dies leaving a Jersey will of immovable estate, the beneficiaries of the immovable estate will need to take steps to register the will of immovable estate at the Jersey Public Registry before ownership of the immovable estate can pass to them. Registration of the will is required before the beneficiaries can rent or sell the properties or land that have been inherited. The role of an executor does not extend to Jersey immovable estate and as such anyone due to benefit under a will of immovable estate should seek legal advice in order to register the will of immovable estate directly. Advice relating to the registration and stamp duty that will be payable can then be provided.
