Unfair and Constructive Dismissal
The Employment (Jersey) Law 2003 protects employees from unfair and constructive dismissal in certain circumstances.
A fair dismissal generally requires an employer to terminate employment (a) for a potentially fair reason and (b) having followed a fair process in the circumstances.
Constructive dismissal is where an employee resigns because an employer has committed a fundamental breach of the employment contract.
We can advise employees and employers on termination of employment and whether or not a person might have a claim for unfair dismissal or constructive dismissal.

Redundancy
There may be a number of reasons why an employer sadly has to make staff redundant. Our team offers specialist advice on handling the redundancy process to help ensure it is conducted in an appropriate manner, satisfying the various controls contained within the law.
