Inheritance Disputes
Inheritance disputes relate to any dispute arising out of either the creation and/or content of a will or the administration, executorship and distribution of a deceased person's estate.
We deal with a wide range of issues, but as a guide, these can include:
- A dispute over the value of estate assets.
- A dispute concerning the terms of an immovable or movable will, including being omitted from the beneficiaries of a will.
- Concerns regarding the deceased person’s state of mind at the time a will was made.
- Issues concerning improper conduct of an executor.
Viberts has a depth of experience in dealing with contentious estate matters and deal with all contentious Jersey probate issues including:
- Making or defending a challenge to a Jersey will’s validity, whether it be on the grounds of incapacity, lack of valid execution, or undue influence.
- Issue of proceedings if a child, spouse or civil partner of the deceased has been left out of a Jersey movable will, or the provision left in the Jersey movable will is less than the minimum required under the Jersey’s forced heirship regime.
- Seeking or defending an order to bring lifetime gifts back into an estate, where the deceased’s property has been gifted away during their lifetime.
- Applications to issue or lift caveats (injunctions) preventing the granting of Jersey probate.
- Actions to remove recalcitrant executors.
